CART TRANSPORTATION • DOWNTOWN RALEIGH, NORTH CAROLINA
I voluntarily choose to ride as a passenger in a motorized cart, golf cart, low-speed vehicle, or similar passenger vehicle operated by Elegant Travels LLC (“Company”) in or around Downtown Raleigh, North Carolina.
I understand that cart transportation involves risks, including sudden stops or turns, falls, collisions, traffic, pedestrians, bicycles, uneven pavement, potholes, weather, and other road or environmental hazards. I voluntarily assume the ordinary and reasonably foreseeable risks of riding as a passenger.
I agree to remain seated while the cart is moving; use any provided seat belt/restraint; keep hands, arms, legs, and other body parts inside the vehicle; follow the driver’s safety instructions; not distract or interfere with the driver; and never ride on any area not designed for passengers. I will not exceed the manufacturer’s seating capacity.
I will enter or exit only when the cart is fully stopped and the driver determines it is reasonably safe. The Company/driver may refuse, delay, reroute, or discontinue a trip when conditions are unsafe, including severe weather, impaired visibility, traffic conditions, or other safety concerns.
I am responsible for my personal belongings. The Company is not responsible for lost, stolen, or damaged property except as required by applicable law.
To the fullest extent permitted by North Carolina law, I release and agree to hold harmless Elegant Travels LLC, DRA, its owners, officers, employees, agents, drivers, and representatives from claims arising from the ordinary risks of my voluntary participation as a passenger. This waiver does not release liability that cannot legally be waived, including gross negligence or intentional misconduct.
A parent or legal guardian must sign for any passenger under 18. The signer confirms that they are the minor’s parent/legal guardian and consent to the minor’s participation.
I have read and understand this waiver, understand the risks of cart transportation, have had an opportunity to ask questions, and voluntarily agree to ride as a passenger. I understand this document does not authorize operation of the vehicle in any manner prohibited by law.
